Empowering Change: Anita Devi's Journey to Justice with the Support of Mountain Forum Himalayas

Background

Anita Devi, a widow from Tachla village in the Narendra Nagar block of Tehri Garhwal, faced tremendous hardship after the tragic loss of her husband in a motor accident over a decade ago. Left to raise her two daughters alone, she struggled against the weight of poverty.

In recent years, her plight worsened when powerful local individuals cut a road from the main highway to her village. This road was constructed without her consent, cutting through her 2 nali of land and resulting in significant damage to her property. The landslide triggered by the road's construction further devastated her home, leaving her in dire circumstances with no one to advocate for her.

Advocacy Efforts by Mountain Forum Himalayas

Recognizing Anita's challenges, the Mountain Forum Himalayas (MFH) stepped in to facilitate her advocacy efforts through their dedicated animator, Phooldas Dhandiya. As part of MFH’s mission to empower local communities, Phooldas worked tirelessly to ensure Anita’s voice was heard.

Initial Outreach and Support

Phooldas began by meeting with Anita to understand her situation in detail. He listened to her story and acknowledged her pain, validating her experiences and encouraging her to seek justice.

Connecting to Resources

Phooldas facilitated Anita’s connection with Mrs. Sarita Rautela, a District Panchayat Member, who provided critical support. She referred Anita to Phooldas and empowered her to take action, highlighting the collaborative spirit fostered by MFH.

Legal Assistance

In July 2024, Phooldas accompanied Anita to the District Legal Services Authority, where she presented her case to the Secretary. Phooldas prepared her application and ensured that her grievances were articulated clearly.

Field Investigation

Following instructions from the Secretary, Phooldas conducted a thorough investigation in the village. He, along with local social worker Dhoom Singh Manwal, gathered evidence about the land damage and met with the village head to discuss the situation.

Community Mobilization

Phooldas organized a joint meeting with the village head, patwari, and local land buyers. This gathering was crucial in establishing a collective understanding of Anita’s land rights. During this meeting, the community recognized that Anita's 390 sq.m. of land was undervalued and acknowledged the need for fair compensation.

Successful Resolution

With Phooldas’s persistent advocacy, it was agreed that the total value of Anita's land was ₹6 lakh 24 thousand. The buyers committed to paying her ₹3 lakh on July 25, 2024, with the remaining amount to be settled at the time of registration. Moreover, it was agreed that Anita would not pursue further legal action regarding the encroachment, providing her with much-needed closure.

Outcome

On July 25, 2024, Anita received a check for ₹3 lakh 24 thousand, marking the successful resolution of her long-standing struggle. Thanks to the advocacy efforts facilitated by Mountain Forum Himalayas and the unwavering support from Phooldas, Anita Devi not only received compensation for her land but also regained her dignity and hope for a better future.
